1. Eligibility

Age Requirements

• You must be at least 13 years old to use the App
• If you are under 18, you must have permission from a parent or guardian
• Parents/guardians who allow minors to use the App agree to these Terms on their behalf

Device Requirements

• iOS 15.0 or later
• Compatible iPhone or iPad
• Internet connection required for: subscription verification, ads (free tier), App Store features

Prices may vary by region and are subject to change.

How to Cancel Auto-Renewal

1. Open iOS Settings
2. Tap your name at the top
3. Tap Subscriptions
4. Select Sorting History
5. Tap Cancel Subscription

Cancellation takes effect at the end of your current billing period. You retain access until then.

3. Billing and Payments

Payment Processing

• All payments are processed by Apple through the App Store
• We do not collect, store, or have access to your payment information
• Prices include applicable taxes where required

Payment Methods

Payment is handled through your Apple ID. Accepted methods include:

• Credit/debit cards linked to your Apple ID
• Apple Pay
• App Store gift card balance
• Apple Cash

Failed Payments

• Apple may retry the charge if a payment fails
• Your subscription may be suspended until payment succeeds
• You may lose access to premium features during suspension

4. Free (Ad-Supported) Tier

What's Included

• Access to 8 categories at launch
• All game modes: Solo Adventure, Pass & Play, and Network Play
• All difficulty settings (Friendly, Competitive, Expert)
• New categories planned monthly via the content cascade

Advertisements

The free tier includes advertisements:

• Small ads displayed at the bottom of screens
• Optional rewarded video ads for hints

By using the free tier, you consent to viewing advertisements and the data collection described in our Privacy Policy.

5. Cancellation and Refunds

Cancellation

• You may cancel your subscription anytime through iOS Settings
• Cancellation stops future charges but does not provide a refund for the current period
• You retain access until the end of your paid period

Refunds

No Partial Refunds

We do not provide partial refunds for:

• Unused time on monthly/yearly subscriptions
• Cancellations mid-period
• Failure to use the App

Lifetime Purchases

Lifetime purchases are non-refundable except as required by law or Apple's refund policy.

6. Acceptable Use

You Agree NOT To:

• Reverse engineer, decompile, or disassemble the App
• Circumvent subscription verification or access premium features without paying
• Use the App for any unlawful purpose
• Interfere with the App's operation or other users' enjoyment
• Attempt to access systems or data you're not authorized to access
• Use automated systems (bots, scrapers) on the App
• Resell, redistribute, or commercially exploit the App or its content

Multiplayer Conduct

When using multiplayer features:

• Treat other players respectfully
• Do not use offensive or inappropriate player names
• Do not attempt to disrupt other players' games

7. Intellectual Property

Our Rights

The App and all its contents are owned by Empty Cup Media or our licensors:

• App design, code, and features
• Historical event data and descriptions
• Graphics, icons, and visual elements
• Text, audio, and other content

All rights not expressly granted are reserved.

Your Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the App for personal, non-commercial purposes
• Access content according to your subscription tier

Historical Content

Historical events and facts presented in the App are drawn from publicly available information. Specific descriptions, presentation, and curation are our original work.

8. Disclaimers

No Guarantee of Availability

We do not guarantee:

• The App will be available at all times
• The App will be error-free or bug-free
• Features will remain unchanged
• Compatibility with future iOS versions

Educational Content

Historical information in the App is for entertainment and general knowledge. While we strive for accuracy, we are not responsible for errors or omissions. Do not rely on the App for academic, professional, or legal purposes.

9. Limitation of Liability

Maximum Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM YOUR USE OF THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $50, WHICHEVER IS GREATER.

Excluded Damages

WE ARE NOT LIABLE FOR:

• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, data, or goodwill
• Interruption of service
• Device damage or data loss
• Third-party actions (including Apple or advertisers)

10. Dispute Resolution

Informal Resolution First

Before filing any legal claim, you agree to contact us at privacy@sortinghistory.com and attempt to resolve the dispute informally for at least 30 days.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. Disputes must be brought individually.

Opt-Out

You may opt out of arbitration by emailing privacy@sortinghistory.com within 30 days of first using the App. Include your name and statement that you opt out.
